1. Embarking on the Journey

Every successful expedition requires clear rules, preparation, and mutual understanding. Welcome to Boreal Outfitters. By accessing our website, purchasing our premium Canadian Rockies outdoor gear, or interacting with our digital basecamp, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website or services.

2. Trail Etiquette & Acceptable Use

We expect all visitors to our site to maintain proper trail etiquette. You agree to use this website only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the website. Prohibited behavior includes:

  • Attempting to gain unauthorized access to our servers, systems, or databases (no digital trespassing).
  • Using the site to transmit any harmful code, viruses, or malware.
  • Engaging in fraudulent purchasing behavior or identity theft.
  • Scraping, mining, or extracting data from our site without express written permission.

3. Gear Specifications and Pricing Accuracy

We strive to describe and display our premium outdoor gear as accurately as possible. However, just as mountain weather can change unpredictably, slight variations in product colors, specifications, or pricing may occur. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (including after you have submitted your order).

4. Orders, Cancellations, and Returns

Submitting an order constitutes an offer to purchase. We reserve the right to refuse or cancel any order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. If your order is canceled after your credit card has been charged, we will issue a credit to your credit card in the amount of the charge.

5. Assumption of Risk and Limitation of Liability

Outdoor exploration in the Canadian Rockies and elsewhere is inherently dangerous. While Boreal Outfitters provides enterprise-grade, premium equipment designed to mitigate environmental challenges, we cannot guarantee your safety. By purchasing and using our products, you explicitly assume all risks associated with outdoor activities.

To the maximum extent permitted by applicable law, Boreal Outfitters shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.

6. Intellectual Property

All content included on this site, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Boreal Outfitters or its content suppliers and protected by international copyright laws. The rugged aesthetic and brand identity are exclusively ours.

7. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any dispute arising from these terms will be resolved in the courts of Calgary, Alberta.
